Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PhishNova, Inc. website and platform ("Services"). By using the Services, you agree to these Terms.

Accounts

You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials. You must notify us promptly of any unauthorized use.

Acceptable use

You agree not to misuse the Services, including by attempting to access them without authorization, interfering with their operation, or using them to violate any law. PhishNova is a security-awareness tool intended to be used on employees and systems you are authorized to test.

Trials and subscriptions

Free trials are provided without charge and without requiring a credit card, and may be modified or discontinued. Paid subscriptions are billed per seat on a monthly or annual basis as described at purchase. Fees are non-refundable except as required by law or expressly stated.

Customer data

As between the parties, you retain all rights to the data you submit to the Services. You grant us the rights necessary to process that data to provide the Services, as further described in our Data Processing Addendum.

Intellectual property

The Services, including all software, content, and trademarks, are owned by PhishNova, Inc. or its licensors and are protected by law. These Terms do not grant you any right to our intellectual property except as necessary to use the Services.

Confidentiality

Each party will protect the other’s confidential information with reasonable care and use it only to perform under these Terms.

Disclaimers

The Services are provided "as is" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free, or that they will prevent every security incident.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, and each party’s aggregate liability arising out of these Terms is limited to the amounts paid for the Services in the twelve months preceding the claim.

Indemnification

You will indemnify us against third-party claims arising from your misuse of the Services or violation of these Terms.

Termination

Either party may terminate for material breach that remains uncured after notice. Upon termination, your right to use the Services ends and we will handle your data as described in the Data Processing Addendum.

Governing law

These Terms are governed by the laws of the jurisdiction in which PhishNova, Inc. is established, without regard to conflict-of-laws rules.

Changes

We may update these Terms; material changes are reflected in the "Last updated" date at the top of this page. Continued use of the Services constitutes acceptance.
